Judgment text excerpt

The Supreme Court upheld the validity of Section 44B of the Madras Hindu Religious Endowments Act, 1926, affirming that the Provincial Legislature had the competence to legislate on inams related to religious endowments. The Court found that the inam in question consisted of both melwaram and kudiwaram, rejecting the trial Court's conclusion that it was a personal inam. The Court also ruled that the resumption of the inam by the Government was lawful, as there was no limitation period applicable, and thus the Mission's claim of adverse possession was untenable.
