Judgment text excerpt

The Supreme Court held that the interest of a partner in partnership assets, which includes both movable and immovable property, should be treated as movable property for the purposes of Section 17(1)(c) of the Registration Act, 1908. The Court ruled that an unregistered deed of relinquishment, which merely recorded the dissolution of the partnership without conveying any immovable property, was admissible in evidence. Consequently, the appeal was decided in favor of the appellants, allowing the unregistered document to be considered valid for the case at hand.
