The Supreme Court held that Section 5 of the Osmania University (Second Amendment) Act XI of 1966, which introduced Section 13A into the Osmania University Act, 1959, was discriminatory against the existing Vice-Chancellor and thus violated Article 14 of the Constitution. The Court found that the classification created by the amendment, which treated the appellant differently from future appointees, lacked a rational basis and was not justified. Consequently, the Court ruled in favor of the appellant, declaring the amendment unconstitutional.
