The Supreme Court held that under Section 7(2) of the U.P. (Temporary) Control of Rent and Eviction Act, 1947, the District Magistrate can issue an allotment order not only when accommodation is vacant but also when it is about to become vacant. The Court ruled that the order takes effect immediately and that the landlords' agreement to continue the tenancy with the appellant constituted a breach of the allotment order, thus validating the District Magistrate's jurisdiction to initiate proceedings under Section 7A. The appeal was dismissed, affirming the lower court's decision.
