The Supreme Court interpreted Rule 15(1) of the Central Provinces and Berar Forest Contract Rules, establishing that the Divisional Forest Officer lacks the authority to determine breaches of contract by the contractor or his agents. The Court held that any disputes regarding contract performance must be referred to the Chief Conservator of Forests as per Clause 9 of the contract. The assessment of damages can only occur after liability is established, thus reversing the Madhya Pradesh High Court's decision that had quashed the compensation order.
