Judgment text excerpt

The Supreme Court held that the requirement of 75% attendance under Regulation 4 of the Patna University Act, 1951, must be interpreted disjunctively for lectures, tutorials, and practicals, rather than cumulatively. The Court found that the High Court's interpretation, which allowed the respondent's attendance percentage to be calculated collectively, was incorrect. Consequently, the Supreme Court set aside the High Court's order and upheld the decision of the educational authorities regarding the respondent's non-eligibility to appear for the examination.
