The Supreme Court held that Sections 23(1) and 23D of the Foreign Exchange Regulation Act, 1947, do not violate Articles 14 and 20 of the Constitution. The Court established that an accused does not have a vested right to be tried by a particular court or procedure unless there is a constitutional objection. Furthermore, the new procedural law is not deemed retrospective as it does not affect any rights under the Criminal Procedure Code, and the penalties prescribed do not exceed those under the previous law, thus upholding the validity of the amendments.
