The Supreme Court held that the failure of the Magistrate to make an endorsement on the summons as required by Section 130(1)(b) of the Motor Vehicles Act, 1939, does not vitiate the proceedings for offences under Sections 112 and 124. The Court clarified that while the Magistrate must issue summons as prescribed, there is no obligation to endorse it in both clauses (a) and (b) of Section 130(1). The appeal was dismissed, affirming the High Court's decision to not accept the Sessions Judge's reference.
