The Supreme Court held that under Rule 55 of the Civil Services (Classification, Control and Appeal) Rules, an enquiry officer is mandated to provide a charge-sheeted officer the opportunity to present oral evidence if requested. The Court found that the refusal to allow the respondent to examine his doctors constituted a violation of Article 311(2) of the Constitution, which guarantees a reasonable opportunity to defend oneself. Consequently, the Court dismissed the appeal of the State Government, affirming the High Court's decision in favor of the respondent.
