The Supreme Court held that the proceedings initiated under Section 12 of the U.P. Agriculturists’ Relief Act were competent despite the repeal of the Act by the U.P. Zamindari Abolition and Land Reforms Act. The Court emphasized that the repeal was retrospective only from July 1, 1952, and did not affect pending proceedings. The jurisdiction of the Assistant Collector under the Abolition Act did not extend to pending actions, thus allowing the Munsif's Court to continue the proceedings.
