Judgment text excerpt

The Supreme Court upheld the validity of the Gujarat Agricultural Produce Marketing Act, 1964, stating that the powers conferred by Sections 5 and 6 are not unfettered and do not infringe upon fundamental rights under Articles 14, 19, and 31 of the Constitution. The Court found that the regulation of retail sales and the eviction powers under Section 30 are reasonable restrictions in the interest of the public. The petitioner's claims regarding the illegality of the Act and the rules framed thereunder were dismissed, affirming the Act's constitutionality.
