The Supreme Court ruled that appointments made under the Mysore Public Service Commission (Functions) Rules, 1957, violated Articles 14, 15, and 16 of the Constitution due to discrimination, as candidates appointed through compromise had lower marks than some rejected candidates. The Court held that such appointments could not be sustained, emphasizing that the foot-note to sub-rule (3) of rule 4 was not intended to bypass merit-based selection. The Court concluded that the appointments of both the 16 candidates from the compromise and the 24 candidates recommended by the Government were invalid due to unequal treatment.
