Judgment text excerpt

The Supreme Court held that the use of the Dhruva star as an election symbol did not constitute a corrupt practice under Section 123(3) of the Representation of the People Act, 1951, as it was too far-fetched to conclude that it would arouse religious sentiments among voters. The Court clarified that the Election Tribunal has a duty to inquire into allegations of corrupt practices, but the High Court is not obligated to examine findings that are not challenged. The election was upheld as the allegations of corrupt practice were not substantiated.
