The Supreme Court held that the respondent's mining lease did not constitute a contract for the supply of goods under Section 7(d) of the Representation of the People Act, 1951. The Court established that for disqualification under this section, there must be a subsisting contract in the course of trade or business, which was not the case here as the lease only granted a right of pre-emption to the Government. Consequently, the election petition challenging the respondent's election was dismissed.
