Judgment text excerpt

The Supreme Court held that wages fixed by an industrial tribunal award are included within the definition of 'wages' under Section 2(vi) of the Payment of Wages Act, 1936. The Court ruled that once an award prescribes a new wage structure, the previous contractual wage structure becomes inoperative and is replaced by the award. The appellant's argument that the wages prescribed by the award must be part of the employment contract was rejected, affirming the applicability of Section 15 of the Act for wage claims arising from the award.
