Judgment text excerpt

The Supreme Court held that Standing Order 22(viii) does not apply to riotous behavior resulting from a purely private dispute unless it has a rational connection to employment. The Court found that the assault by R on A was related to a disagreement over an incentive bonus scheme, thus falling within the purview of the Standing Order. The Court also ruled that the Industrial Tribunal erred in concluding that the domestic enquiry was conducted contrary to the principles of natural justice, affirming the validity of the dismissal of R.
