Judgment text excerpt

The Supreme Court declared the Madras Land Reforms (Fixation of Ceiling on Land) Act, 1961 unconstitutional, holding that Sections 5(1) and 50 violate Articles 14 and 31(2) of the Constitution. The Court found that Section 5(1) discriminates between similarly situated individuals, thus breaching Article 14, and that the compensation provisions under Section 50 are also discriminatory. As both pivotal sections were struck down, the entire Act was deemed unconstitutional.
