The Supreme Court held that under Article 295(2) of the Constitution of India, the State of Rajasthan is liable for the obligations of the former State of Dholpur, as the new State recognized these liabilities by continuing the old laws without change. The Court dismissed the appeals, affirming that the rights of the subjects and the liabilities of the old State were acknowledged during the integration process from 1948 to 1950. The Court found no law that negated the right to claim a refund of excess export duties paid by the respondents.
