The Supreme Court held that the Bihar State Universities Act, 1960, distinguishes between collegiate institutions owned by the university and those merely affiliated. It ruled that while the university can disaffiliate institutions for non-compliance, it cannot unilaterally dissolve and reconstitute the Governing Body of an affiliated college. The Court found Clause 2(4) of the Statutes inconsistent with Section 30(d) of the Act, rendering it invalid, and thus the Vice-Chancellor's order was declared invalid and inoperative.
