Judgment text excerpt
The Supreme Court held that the abolition of all posts in an establishment does not constitute a reduction of posts under Item 1 of Schedule II of the Central Provinces and Berar Industrial Disputes Settlement Act, 1947, and thus does not trigger the procedural requirements of Section 31 of the Act. The Court affirmed the validity of the Government's order terminating the services of employees from the Provincial Transport Services, as it was not deemed a change under the Act. Consequently, the appeal against the Bombay High Court's decision was dismissed.
