Judgment text excerpt

The Supreme Court held that under Section 20 of the U.P. Zamindari Abolition and Land Reforms Act, 1950, a person recorded as an occupant in the Khasra for 1356 Fasli is entitled to retain adhivasi rights without needing to prove actual possession if they were evicted after June 30, 1948. The Court ruled that the correctness of the Khasra entry cannot be questioned if not corrected before the date of vesting (July 1, 1952). The appellant's plea regarding the entry's correctness was dismissed, affirming the lower courts' decisions in favor of the respondents.
