The Supreme Court held that under Section 13(2) of the West Bengal Premises Rent Control (Temporary Provisions) Act, 1950, a sub-tenant automatically becomes a tenant of the landlord upon the determination of the tenancy of the tenant in chief. The court clarified that the terms of the tenancy remain unchanged, and the sub-tenant's tenancy continues from the beginning of the month, irrespective of the date of the decree for ejectment against the original tenant.
