Judgment text excerpt

The Supreme Court held that under Section 13(2) of the West Bengal Premises Rent Control (Temporary Provisions) Act, 1950, a sub-tenant automatically becomes a tenant of the landlord upon the determination of the tenancy of the tenant in chief. The court clarified that the terms of the tenancy remain unchanged, and the sub-tenant's tenancy continues from the beginning of the month, irrespective of the date of the decree for ejectment against the original tenant. The appeal was dismissed, affirming the High Court's decision regarding the validity of the notice for possession.
