The Supreme Court held that the Certifying Officer under the Industrial Employment (Standing Orders) Act, 1946 had no jurisdiction at the time of submission of the draft standing orders on June 9, 1960, but acquired jurisdiction before certifying them on August 6, 1962. The Court ruled that the certification could not be deemed void due to the initial lack of jurisdiction, as the application was effectively renewed once jurisdiction was established. The appeal against the Industrial Court's decision was thus dismissed, affirming the validity of the certification.
