The Supreme Court held that the Chief Commissioner of Pondicherry, as a quasi-judicial authority, is not 'under the control of the Government of India' as defined in Article 12 of the Constitution, and thus Article 15 does not apply to him. The Court ruled that since Pondicherry was not part of India at the time of the permit denial, no writ could be issued retrospectively after it became part of India. The appeal was dismissed, affirming the Chief Commissioner's decision regarding the stage carriage permit.
