Judgment text excerpt
The Supreme Court held that the abolition of watan rights does not alter the tenure of land held as watan unless expressly agreed upon. Under Section 9 of the Bombay Paragana and Kulkarni Watans (Abolition) Act, 1950, the holder is entitled to compensation for the extinction of rights in watan land. The Court affirmed the High Court's order directing the Collector to assess and pay compensation, establishing that loss of watan rights is compensated by regranting occupancy rights in the land.
