The Supreme Court held that under Section 4 of the Patiala Recovery of State Dues Act, the Head of the Department has the authority to determine both the amount of State dues and the liability of the alleged defaulter. The Court clarified that Section 11 of the Act ousts the jurisdiction of civil courts in matters concerning the determination of State dues and defaulters' liabilities. The appeal was dismissed as the Insolvency Court retained the power to adjudicate on insolvency matters, but the Respondent's claim of not executing a guarantee deed was upheld.
