Judgment text excerpt

The Supreme Court held that Clause 7 of the agreement between the workers and management referred to the period of suspension only up to the date of the agreement, not thereafter. The Court established that a workman suspended pending inquiry is entitled to wages if reinstated, and the Tribunal was justified in awarding wages for the suspension period after the agreement. The Court ruled that all 29 suspended workmen were entitled to full wages from the date of the agreement until the award date, as there was no provision allowing suspension without pay.
