The Supreme Court held that under Section 33(c)(2) of the Industrial Disputes Act, 1947, the Labour Court has jurisdiction to determine a workman's entitlement to benefits under an award. The Court rejected the preliminary objection raised by the respondent Bank regarding the Labour Court's jurisdiction. It was established that the appellant, appointed on December 14, 1953, was entitled to annual increments on that date each year, as he was not part of the 'existing staff' referred to in para 292 of the Sastry Award. Consequently, the appeal was allowed, affirming the appellant's right to the claimed benefits.
