Judgment text excerpt

The Supreme Court held that the withdrawal of tenant protection for non-residential buildings in Tanjore under the Madras City Tenants Protection Act, 1921, as amended, did not violate Articles 14, 19, and 31 of the Constitution. The Court found that the differentiation between Tanjore and other towns was justified based on real differences in accommodation pressure and population. It established that the right to purchase property under a statute is akin to a contractual right and does not constitute a fundamental right to property under Article 19(1)(f). The High Court's validation of the Act was upheld.
