Judgment text excerpt

The Supreme Court held that under Section 4(1)(a) of the Madhya Pradesh Abolition of Proprietary Rights (Estates, Mahals, Alienated Lands) Act, 1950, all rights, title, and interest of proprietors in the specified areas vest in the State upon notification, rendering any prior rights claimed by respondents void. The Court clarified that Section 6(1) does not save rights acquired before March 16, 1950, as it pertains to transfers made after that date. Consequently, the rights claimed by the respondents could not be enforced against the State, and the previous ruling in Chhotabhai Jethabhai Patel and Co. v. State of Madhya Pradesh was overruled.
