The Supreme Court held that a party must establish title to property before claiming infringement of fundamental rights under Articles 19(1)(f) and 31(1) of the Constitution. In this case, the petitioners' claim was dismissed as they could not demonstrate ownership while the title was under adjudication in proceedings initiated under Section 4(h) of the Bihar Land Reforms Act, 1950. The Court ruled that until the title is established, no claim of infringement can be made.
