The Supreme Court held that the notification dated June 23, 1961, was not discriminatory under Article 14, as the imposition of fees was based on bye-laws framed by the market committee under Section 11 of the Bombay Agricultural Produce Markets Act, 1939. The Court found that the classification of traders into A and B classes was valid and did not violate Article 14, as each agricultural produce could be treated as a separate class. Additionally, Section 29-B was deemed sufficient to validate prior actions and rectify defects identified in earlier judgments, thus upholding the validity of the amendments made by the Ordinance.
