The Supreme Court held that the dismissal of Jai Jai Ram was valid as the charges against him were substantiated through a proper departmental enquiry. However, the dismissal of Mohd. Mia was deemed invalid because the employer failed to communicate the dismissal order to him, which is a requisite for termination of employment. The Court directed the employer to pay Mohd. Mia wages from December 1, 1958, to July 27, 1962. The Court clarified that the Tribunal can only review the merits of a case if it finds that the enquiry was not conducted properly or the findings were perverse, thus upholding the procedural integrity of the Industrial Disputes Act, 1947.
