The Supreme Court held that under Section 12 of the Displaced Persons (Compensation and Rehabilitation) Act, 1954, evacuee property in the villages allotted to the appellants ceased to be classified as evacuee property and became part of the compensation pool. The Court ruled that any variation or cancellation of the allotment could only be executed under Section 19 of the same Act, thereby invalidating the Central Government's reliance on Rule 14(6)(iii)(d) of the Administration of Evacuee Property Act, 1950. The appeal was allowed, reversing the Punjab High Court's dismissal of the writ petition.
