The Court distinguished the case from Mr. Ziakh v. Firestone Tyre and Rubber Co. Ltd., affirming that the scheme in question required workers to produce up to the norm, and any failure to do so constituted misconduct. The Court ruled that the payments made for production up to the norm must be included in the definition of basic wages as per Section 2(b) of the Act.
