The Supreme Court held that the dismissal of the employee Kundlik Tulsiram was invalid as it was not preceded by a proper enquiry, violating the principles of natural justice. The Court found that the Labour Commissioner had jurisdiction to hold an enquiry under Section 16 of the C. P. & Berar Industrial Disputes Settlement Act, 1947, and that the Industrial Court's finding was perverse. The Court quashed the Industrial Court's order and restored the Labour Commissioner's decision to reinstate the employee with back wages.
