Judgment text excerpt

The Supreme Court held that the right of minorities to establish and administer educational institutions under Article 30(1) of the Constitution of India includes the right to manage such institutions without undue interference from the state. The Court found that the imposition of a reservation policy for government-nominated teachers infringed upon the society's fundamental rights, particularly under Articles 30(1) and 19(1)(f). Consequently, the Court issued a writ of mandamus directing the State of Bombay to refrain from enforcing the reservation policy and to restore the recognition and grant-in-aid to the college.
