Judgment text excerpt

The Supreme Court held that the occupation of bungalow No. 127-B by a Military Officer constituted occupation by the Central Government under Section 99(2)(f) of the Cantonment Act, 1924. The Court affirmed the High Court's finding that such occupation amounted to user for public purposes as per Section 84(2) of the Cantonments Act, 1924. Additionally, the Court ruled that the authentication of the assessment list was valid under Section 96 of the Cantonments Act, 1924, thereby upholding the High Court's decision on two questions and reversing it on one.
