The Supreme Court held that under Section 12(5) of the Industrial Disputes Act, 1947, an individual dispute can only be converted into an industrial dispute if it is supported by a significant number of employees from the same employer. The Court ruled that the dispute between the 'Hindu', Bombay, and the third appellant was merely an individual dispute, as it lacked support from a considerable section of the workmen. The appeal was dismissed, affirming the Industrial Tribunal's decision that it had no jurisdiction to adjudicate the matter.
