The Supreme Court held that under Section 13(1)(e) and Section 13(1)(h) of the Delhi and Ajmer Rent Control Act, 1952, a tenant using premises for both residential and professional purposes cannot be evicted solely on the grounds of requiring the premises for personal residence or having acquired alternative accommodation. The Court found that the tenant's use of the premises for professional work, with the landlord's consent, transformed the nature of the tenancy, thus preventing eviction under the cited sections.
