The Supreme Court held that after the enactment of the Displaced Persons (Compensation and Rehabilitation) Act, 1954, the Custodian General lost the power to cancel allotments of evacuee property. The Court ruled that the issuance of a notification under Section 12(1) of the Act extinguished the evacuee's rights and vested the property in the Central Government, thereby ending the Custodian's management authority under the Administration of Evacuee Property Act, 1950. The appeal was dismissed, affirming the Custodian General's refusal to revise the cancellation order.
