Judgment text excerpt

The Supreme Court held that under Section 5 of the Punjab Laws Act, 1872, Hindu law governs succession in Punjab, but if a custom differing from Hindu law is established, that custom prevails. The Court ruled that an adopted son can inherit from his natural father only if there are no other sons; since Munshi Ram's natural father had predeceased his grandfather and another son existed, Munshi Ram could not inherit. Thus, the appeal was dismissed, affirming the Punjab High Court's decision.
