The Supreme Court held that under Section 3 of the U.P. (Temporary) Control of Rent and Eviction Act, 1947, a landlord can file for eviction with the District Magistrate's permission, which can also be granted by an officer authorized by the District Magistrate. The Court ruled that the Additional District Magistrate, Mr. Seth, was validly empowered to grant such permission, thus rejecting the appellants' claim that only the District Magistrate could do so. The judgment of the Allahabad High Court was upheld, affirming the eviction and damages awarded to the respondent.
