Judgment text excerpt
The Supreme Court held that the divisions made by Panchas in a joint Hindu family property were binding on the parties, as they had voluntarily accepted and acted upon the award. The Court clarified that the revocation of the reference to arbitration did not invalidate the divisions already executed, and the parties ceased to be members of the joint family upon acceptance of the award. The Court ruled that the documents recording the division did not require registration under Section 17 of the Registration Act, 1908, as they merely acknowledged partitions already made.
