The Supreme Court held that Section 76 of the Mines Act, 1952, allows for the prosecution of any shareholder of a private company owning a mine for offences committed under the Act, interpreting 'any one' as 'every one', thus upholding its constitutionality under Article 14. The Court also ruled that compliance with Section 59(3) of the Mines Act, 1952, requiring consultation with a Mining Board before framing regulations, is mandatory. The appeal was dismissed, affirming the validity of the prosecution against the appellant for contraventions of the Coal Mines Regulations, 1957.
