The Supreme Court ruled that the appellant, granted a Lambardari lease in 1945, was not a 'jagirdar' under the Vindhya Pradesh Abolition of Jagirs and Land Reforms Act, 1952, specifically Section 2(1)(C). The Court held that the term 'Ijaredar' in the Act referred to a person holding a lease or farm of land revenue, and since the Lambardari lease conferred rights in the land itself, the appellant did not fall within the definition of 'jagirdar'. Consequently, the resumption of her rights was deemed unauthorized and the notification was quashed.
