Judgment text excerpt

The Supreme Court held that under Section 70 of the Indian Contract Act, 1872, a party who renders services with the intention of receiving compensation is entitled to be compensated for the value of those services, even if there is no express provision in the contract. The Court ruled that the respondent, a building contractor, was entitled to compensation for additional work not covered by the written agreement, despite failing to prove his claim for compensation at the prevailing market rate. The appellant's suit was dismissed, and he could not re-agitate the compensation issue in the companion suits as no equitable set-off was claimed.
