Judgment text excerpt
The Supreme Court ruled that for a writ of mandamus to be issued, there must be a legal duty imposed by statute and a corresponding legal right for the aggrieved party to enforce that duty. In this case, the appellant's appointment as Principal of Nalanda College was not approved by the University Syndicate as required by the University Statute, and thus, the appellant failed to demonstrate any enforceable right under Article 226 of the Constitution. Consequently, the appeal was dismissed, affirming the High Court's decision.
