The Supreme Court ruled that the material date for determining whether a plot of land qualifies as 'premises' under Section 5(8) of the Bombay Rents, Hotel and Lodging Houses Rates Control Act, 1947 is the date of letting, not the date of the application for fixing standard rent. In this case, since the land was assessed for agricultural purposes at the time of letting, it could not be considered 'premises' under the Act, rendering the application for standard rent fixation unmaintainable. Consequently, the appeal was dismissed.
