The Supreme Court held that the right to receive a pension under the U.P. Zamindari Abolition and Land Reforms Act, 1951, is not an interest in land or immovable property as defined under Section 32 of the U.P. Land Revenue Act, 1901. The Court clarified that the pension was compensation for the loss of rights over land and not a derivative right in the estate. Consequently, the cessation of payment of the pension by the revenue authorities was held to be invalid, as the pension did not vest in the State under the Act.
